The purchase of furniture through Philip Caggiano Ltd (hereinafter “the Products”) is governed by the terms and conditions of sale stated below and the General Terms and Conditions of Philip Caggiano.com

Price The price of the Furniture Products displayed are sold in US dollars, excluding taxes, duties, import and export fees, costs for storage, transportation and insurance, art handling, and packing which are payable by Client over and above the listed price. Each order must be paid for at the price initially agreed upon by a representative of Philip Caggiano. Our representatives reserve the right to modify the prices of Products offered at any time without prior notice. You will be charged the price agreed upon in your purchase order and initial quote. Philip Caggiano reserves the right not to accept or to cancel your order if we cannot furnish the Products in the agreeable time for delivery or we have a materials shortage for fulfillment by supplying vendor.

Bespoke: Due to the custom nature of each and every item produced by Philip Caggiano specific terms and conditions apply for all custom orders. Our pricing reflects the hand made nature and luxurious materials implemented into each item to the client’s specification. Our products are not ready to ship stock items and are made to order. Almost all orders are Bespoke and custom therefore pricing will be discussed in advance. Pricing for any custom “one-off” design will be based on a general quotation to the client based off our standard production collection. Please note that this is just a baseline before the final price and payment is due upon delivery. Specific manufacturing and material costs are not within our control from suppliers therefore prices are subject to change without notice. Philip Caggiano is not a manufacture of raw materials such as steel, aluminum, brass, precious metals, textiles, leather, wood, carbon fiber, fasteners and special finishes. All clients will be notified of any changes as production commences. Any changes to any custom order for sizing, finish or other will be up-charged to the client at specified cost and must be made within 7 days of initial placement of order. A change order must be submitted and signed by the client and a representative of Philip Caggiano.

Engineering and Digital Renderings: Philip Caggiano provides in house engineering and design staff to bring any concept or wish to reality. Our studio designer will draft up blueprints to scale, digital 3D realistic renders to the exact detail prior to approval and production. An initial retainer must be made to initialize this service to all retail and commercial trade clients. The fees will be later applied towards your order. Philip Caggiano remains sole owner of all intellectual property created for each client unless specified under a contract or agreement with client.

 

PAYMENT Full payment is required to initiate all custom and bespoke orders. All new orders are considered custom and bespoke unless otherwise noted. If an existing production cycle is in effect an order can be placed by initially paying 60% upfront with the remaining balance due prior to delivery. Orders being drop shipped directly to client must also be paid in full at time of purchase and a purchase order must be approved prior to delivery arrangements.  Payment can be made in the form of, American Express, Bank Transfer, Corporate Check, Certified Check or Cash.

TAXES Prices do not include any applicable sales, use, excise, or any other tax. Buyer agrees to pay all applicable taxes, which will be added at the time of invoicing.  Out of state and International sales are not taxed. Commercial Trade firms holding valid resale certificates are not taxed as long as payment is made by corporate representatives through respective financing accounts submitted at time of sale.

Delivery Shipping and delivery charges are not included in the cost of goods. Drop shipping directly to the client may be available at an added cost. Special Packing, crating and foam encasement is an additional cost paid for by each buyer to ensure a safe delivery anywhere in the world: Buyer agrees to pay all reasonable extra charges. Philip Caggiano will offer each buyer quotes for shipping and delivery domestic and international. We will also suggest an international brokerage team for International transactions. Delivery will be during normal business hours and each carrier will call prior to make arrangements. Deliveries must be signed for no exceptions. Request for lift-gate will be an additional cost and must be arranged prior to shipment from our facility

Damage Claims All claims for damages occurring before or during delivery must be reported to Seller within 24 hours of delivery.  We facilitate shipping and delivery as a courtesy and are not responsible for damages incurred during transit. All purchases will be fully insured and properly packed by professionals.  If damages do occur they must be reported within 24 hours of receipt and all packing materials must be saved for inspection. We will contact the carrier and make a claim on your behalf but Philip Caggiano will not be held responsible in any way or entitle a refund under these circumstances.

CHANGES AND CANCELLATIONS

All sales are final. Refunds are not issued except in the case of defective merchandise.  Orders for custom manufactured furniture may not be changed or cancelled. Once placed, these orders are non- returnable, exchanged for credit or refund. 

Warranty The Products are designed for use as furniture. The Products must be maintained consistent with the instructions issued by Philip Caggiano and must be used in accordance with the purposes for which they were designed. Each hand made item is unique and will showcase the personality of the craft and convey true luxury of ownership for many years to come. Our warranty covers all manufacturer’s structural defects for 10 years from the date of purchase not the date of delivery. A structural defect is defined as: a failure, material or mechanical, of the supporting structure of the furniture. For example: the frame of a sofa or the legs on a cocktail table. This excludes the materials on the frame (foam, fabrics, lacquers, leathers, varnish etc.) which are covered under a separate warranty. For material substances and upholstery (leather, fabrics, foam, varnishes, patinas) we offer a 5 year warranty for material failure. This does not include “Wear and Tear” or “Natural Characteristics” See Exclusions below. Moving parts, including both manual and electrical mechanisms, are covered for 5 years from the date of purchase if properly maintained See Exclusions below. “Wear and Tear” and” Natural Characteristics” are not covered by our warranty under any circumstances. Some traits of “Wear and Tear” and “Natural Characteristics” are listed below.  Stretching and warping of seat upholstery (leather, fabric, or other materials) due to normal use. These materials will change with use and natural exposure to abrasions, sunlight, liquids, rubbing, scratching, pulling, and stretching. This includes the stitching. Wrinkling is also a natural effect of hand upholstered leather and fabric, and is not considered a defect. Fading (of seats, upholstery, stains, carpets, woods, lacquers, etc.) caused by exposure to sunlight and other abrasions, are not covered under warranty.  Staining of porous materials due to normal use is also not covered under warranty. Scratching or indentation of materials such as glass or lacquered materials. Warping or movement of wood materials due to natural conditions such as humidity.  Natural characteristics of natural materials such as wood and leather are not covered by the warranty, and are not considered defects: Stretch marks, variation in grain / pattern, and knots are typical examples. Poor assembly, adjustment, setting or other actions taken by people who are not authorized by Philip Caggiano. Use in public or professional settings, unless the model is appropriate for such use and this has been specified on the order form.  Deteriorations due to improper use  Repairs or modifications done by clients or by a third party not authorized by Philip Caggiano
